Hundreds of consumers, being represented by local lawyer Duncan Heuer, will ask the court to declare the contracts between the banks and car buyers null and void.

"We were in judges chambers yesterday morning and afternoon, with the various respondents being the banks: Standard Bank, Nedbank and Absa. The banks have now opposed it filed their opposing papers and now the judges have given us direction to file further replying papers and heads of argument," he said.

Heuer says they are also creating a database of affected consumers.

"The whole reason for the database is to keep people updated this is by no means a line that you have to register on it, in order to be part of this case. The judge will order, if we are successful, on directions on how people will either opt in to be part of the case or opt out," he said.
