The Supreme Court of Appeal last week upheld a High Court judgement, which found Motsoeneng's appointment invalid.

Madonsela said she wrote a letter to Communications Minister Faith Muthambi - warning her that appointing Motsoeneng as acting COO would be in contravention of not only the Public Protector's report, but also the findings of the court.

"I did say that if Motsoeneng is appointed as acting COO or another senior executive position at the SABC, it would be a violation of the spirit of that judgement," she said.

Madonsela stated in no uncertain terms she would ensure due process was followed in appointing Motsoeneng as General Executive of Corporate Affairs.

"The starting point will be to find out what was the process of appointing him. Was that position vacant? What was the position's requirements before he was appointed to it? Because that position would have been advertised before the previous incumbent."

Madonsela said she and her team are in a race against time to finalise outstanding reports and will not let anything get in their way.

The Public Protector has 14 days left in office, and said she is working round the clock to finalise several high profile cases as well as well as complaints from the general public.

The yet-to-be completed probes include report on Prasa, corruption in RDP homes as well as a probe into alleged state capture.

Madonsela also addressed allegations that she is a CIA spy and an agent of white capital and said she has no time to play childish games.

"I just believe that particular issue is grown-ups behaving like children just playing a game and I've decided I really don't want to engage in that game. I really don't have the time. Right now I will not deal with it, I will not do anything about it," she said.
