CASAC asks court to interdict Zuma announcement
Updated | By Pieter van der Merwe
The National Director of Public Prosecutions (NDPP) Shaun Abrahams recently confirmed he is ready to announce a decision on whether or not to prosecute former president Jacob Zuma.
The Centre for the Advancement of the South African Constitution (CASAC) has launched an urgent court application to interdict Abrahams from announcing his decision on the so-called Spy Tapes matter.
Abrahams recently confirmed he has made a decision on whether or not to prosecute Zuma on charges of corruption, money laundering and racketeering.
The decision follows representations from Zuma, on why he should not be charged, studied by a team of prosecutors appointed by Abrahams.
But CASAC believes it should wait for judgement by the Constitutional Court.
CASAC last week argued before the court that it believes Abrahams is conflicted and asked it to uphold a High Court ruling - which effectively set Abrahams' appointment aside.
"We had argued in the Constitutional Court last week for him to give an undertaking to the court that he would not make a decision until such time as the court ruled," says CASAC's Lawson Naidoo. "He failed to give that undertaking."
The Constitutional Court last week reserved judgement in the matter and is yet to announce when it plans to rule on the matter.
