Small Claims Court access expanded with R30k claim limit
The monetary limit for Small Claims Courts has increased from R20 000 to R30 000, allowing more South Africans to resolve civil disputes without the burden of costly legal processes.
Palesa Rammitlwa, spokesperson for the Minister of Justice and Constitutional Development, says the adjustment will expand access to justice by helping more people avoid the high costs and delays often associated with traditional court proceedings.
She says the increase means disputes can be determined on their merits rather than by an individual’s financial ability to pursue lengthy litigation.
Small Claims Courts deal with a range of civil matters, including unpaid debts, faulty goods, service-related disputes, property claims and damages.
More than 36 600 cases valued at R257 million were registered in the last financial year, with 418 Small Claims Courts operating across the country.
Rammitlwa says the increase, which is the first adjustment since 2019, ensures the courts keep pace with rising costs while remaining an affordable avenue for South Africans to enforce their rights.
“Small Claims Courts were established to provide people with a simple, affordable and accessible means of resolving civil disputes. By increasing the monetary jurisdiction to R30 000, we are enabling more South Africans to enforce their rights without having to embark on costly and time-consuming litigation,” said Rammitlwa.
Deputy Minister of Justice and Constitutional Development Andries Nel says expanding access to Small Claims Courts supports the country’s constitutional commitment to ensuring that rights are not only protected in principle but can be exercised by all citizens.
“As we celebrate thirty years of our Constitution, we reaffirm that its promise must be measured not only by the rights it proclaims, but by the extent to which those rights can be exercised by every person, regardless of their means,” said Nel.
Rammitlwa says strengthening the Small Claims Court system is part of government’s broader efforts to build a people-centred justice system that is accessible, affordable, efficient and responsive to the needs of communities.
