The court dismissed the application on Tuesday

The lobby group headed to court after Minister of Cooperative Governance and Traditional Affairs Nkosazana Dlamini-Zuma refused to respond to their demands to provide them with evidence supporting the curfew.

“It’s disappointing  that the court found that this case was not urgent because we felt like it is,” says AfriForum's Jacques Broodryk.

“We know that hundreds of thousands of jobs have been lost in the tourism sector and hospitality industry because of lockdowns and those industries will continue suffering over December because of these types lockdown.”

Broodryk says they believe the matter is urgent due to the reliance of the tourism and hospitality industry on the festive season.

"The reason why we see this matter as urgent is because many of these establishments rely on the holiday season to make their money to carry them through the rest of the year and putting restrictions on them during the holiday season is just going to further negatively affect these industries.

"Our legal team is currently looking at the matter and we’ll make decision regarding what I’ll next steps will be soon."
