Court postpones appeal case against Covid-19 jab for minors

A new committee has postponed an appeal case against the approval of the Covid-19 vaccine for children aged 12 to 17 years of age.
The matter, which was held virtually on Friday, was brought by the Free the Children Save the Nation against the South African Health Products Regulatory Authority (Sahpra).
Free the Children Save the Nation has sought to appeal a decision by Sahpra to approve the Covid-19 jab for minors.
Committee chairperson Advocate Tembeka Ngcukaitobi postponed the matter to the end of May.
He cited a lack of documentation and witnesses from Sahpra as a reason for the postponement.
"The regulator has no right to remove the documents from the record of decision. That is the only issue. In time it will have to justify why it has removed the records of decision,” he said.

"We have a situation where we must deal with an appeal but it must be based on a decision and full record.
"I'm not making any ruling at this stage. I am simply telling the parties that the correct approach on the matter is not a fight about confidentiality but a full record of decision.
"It has nothing to do with the public and the contract between the department and Pfizer, it has everything to do with us performing our functions under section 4A we need a full record of decision.
During the hearing Sahpra legal representative David Mtsweni told the Committee that Pfizer documents were confidential and therefore could not be made public.
He added that if Free the Children, Save the Nation wanted the documents they would then have to go to Pfizer and request them.
The matter has been adjourned for 31 May 2022.
