Court rejects ANC MP's application to drop murder charges
The Orkney Magistrate’s Court has rejected ANC MP Sibusiso Kula's application to have murder charges against him dropped.
Kula is accused of stabbing his 31-year-old wife Jennifer Mothlomi to death at their North West home in November last year.
Following his release on R50 000 bail, Kula approached the court to have the charges against him dropped.
He claimed that his rights were not explained to him at the time of the arrest.
National Prosecuting Authority (NPA) North West spokesperson Henry Mamothame says the matter has been postponed to 30 June for further investigations.
"Kula’s defence indicated to the court that they will register a review application following the judgment. They have also requested to be furnished with a list of witnesses, as ordered by the high court when it granted him bail.
“In their application, they argued that his rights were not explained to him, and thus can be used against him in a subsequent trial.
“They further questioned the charges levelled against their client.”
Mamothame says an application submitted to the Office of the Director of Public Prosecutions for the matter to be transferred to a higher court is awaiting the finalisation of investigations.
"Investigations are nearing completion as the state prepares for trial.”
