Court rejects Mapisa-Nqakula’s bid for case diary access

The High Court in Pretoria has dismissed an application by former National Assembly Speaker Nosiviwe Mapisa-Nqakula to compel the State to disclose the investigation diary in her ongoing corruption case.

Judge Mokhine Mosopa ruled that Mapisa-Nqakula failed to establish a legal basis for accessing a section of the police docket, which includes the investigation diary containing details such as when police began their inquiry and meetings with witnesses.
“The applicant failed to demonstrate the risk of such impediments, in my considered view, and did not establish a prima facie fact indicating the relevance of disclosing the C-section of the police docket."
Mapisa-Nqakula’s legal team had argued that the information in Section C could potentially exonerate her from the charges.
She is facing 12 counts of corruption and one count of money laundering linked to her tenure as Minister of Defence, during which she allegedly solicited and received R4.5 million, of which R2.1 million was allegedly handed over in cash by a service provider.
Her bail of R50,000 was extended until her next court appearance.
