Culpable homicide charges looming against those implicated in Enock Mpianzi death

The family of 13-year-old Enock Mpianzi are set to lay charges of culpable homicide against those implicated in the drowning of the Parktown Boys’ High School pupil.

A forensic report released on Wednesday found that the Nyati Bush and River Breakaway in Brits, the school’s headmaster and five educators were reckless and negligent.

 

Mpianzi drowned in the Crocodile River while on a grade 8 orientation camp in January.

 

The lawyer representing the Mpianzi family Ian Levitt says it’s clear that teachers and officials were negligent.

 

The report found that Enock was not wearing a life jacket and that a proper roll call was not done, resulting in his body only being found two days later.

 

"The steps my client will be taking following the release of the report yesterday will be taking all action against those implicated and found negligent or reckless or both,” says Levitt.

 

"Criminal charges can be laid and they will be laid because anyone involved in the negligent killing of another human being would be guilty of culpable homicide.”

 

The Gauteng Department of Education and several other institutions will also be served with summons in the coming weeks.

 

"Definitely summons will be issued, summons will be prepared over the next coming weeks," says Lewitt.

The school's governing body (SGB) has requested for some space and time to study the findings and pledged its full commitment to the investigations by the police and the provincial education department.

 

In a statement, it says members of the body are singularly focused on supporting pupils, staff and the Mpianzi family.

 

The body pleaded with protestors - seeking justice - to do their demonstrations peacefully and respectfully - to ensure pupils and staff are not further traumatised.

 

"We remain utterly committed to ensuring Enock and the Mpianzi family receive the justice they deserve," the statement reads.
