DA files no-confidence motion against Tshwane deputy mayor

The Democratic Alliance in Tshwane has filed a motion of no confidence in Deputy Mayor and Finance MMC Eugene Modise, accusing him of personally benefiting from a multimillion-rand security contract with the municipality.

According to the DA, an investigative report by the City of Tshwane confirms that Modise failed to disclose his financial interest in Triotic Protection Services — a company with lucrative contracts to provide watchman security services to the city.


DA mayoral candidate Cilliers Brink said the findings amount to a serious breach of the Municipal Systems Act, which prohibits councillors from benefiting from municipal contracts.


"If this rule is important for councillors, it’s essential for a Finance MMC — the person responsible for the city’s finances and supply chain management."


The report allegedly shows that Modise, who became a councillor in February 2023, told investigators he had sold his shares in Triotic through an instalment sale agreement.


However, he could not produce proof of the sale, and investigators found that he continues to benefit financially from the company’s municipal contracts.


The DA says Modise’s actions, coupled with his failure to divest his interests and disclose them to council, constitute a material breach of the councillor code of conduct.


The controversy deepened after Modise reportedly told journalists he had been cleared by the Public Protector, a claim the watchdog’s office has since refuted.


Earlier this year, the city extended contracts for Triotic and several other private security firms without following a competitive bidding process — a move that resulted in R170 million in irregular expenditure. 


The DA has also raised concerns about another Modise-linked property owing R23 million in municipal debt, despite services not being disconnected.


Brink criticised Mayor Nasiphi Moya, who represents ActionSA, for failing to act decisively on the matter, accusing her of protecting Modise, the ANC leader in council, to preserve her fragile coalition with the ANC and EFF.


"By keeping Modise on as Finance MMC, Mayor Moya is jeopardising Tshwane’s finances and the integrity of her own administration."


The motion of no confidence seeks to remove Modise as deputy mayor and compel Moya to take action on his future as Finance MMC.
