Fita leave to appeal application to be heard next week

The High Court in Pretoria will hear the Fair-Trade Independent Tobacco Association’s (Fita) leave to appeal application next week.
The application, against a previous ruling on the ban on the sale of tobacco products, will be heard on July 15.
Fita wants to appeal a ruling in the same court which upheld the ban on the sale of tobacco products during level 3 of the lockdown.
Fita believes the court made several errors in its interpretation of the Disaster Management Act.
Fita chairperson Sinenhlanhla Mnguni said the group is hopeful that the court will rule in their favour.
"We are confident in our arguments raised in our application leave to appeal and we are rather hopeful that we will be successful in having the court grant us the leave to appeal the ruling which was made previously.”
The state maintained that the use of tobacco products during the Covid-19 pandemic posed a health risk.

In its application for leave to appeal, which was lodged on Friday, the group said the court made several errors in its interpretation of the Disaster Management Act. Fita chairperson Sinenhlanhla Mnguni believes the Supreme Court of Appeal in Bloemfontein will come to a different conclusion.
