The family of anti-apartheid activist Ahmed Timol says apartheid-era police office  Joao Rodrigues escaped with the truth.

Rodrigues died on Monday after a long illness.

He was charged Timol's murder.

The anti-apartheid activist died in 1971 five days after being arrested in Johannesburg.

Rodriques is accused of pushing Timol off a ten storey window at the John Voster sqaure police station.

He was scheduled to attend the criminal trial after an inquest into Timol's recommended Rodrigues be investigated for perjury.

"They successfully delayed and stalled this particular matter ensuring he is not held accountable. That is the painful reality, and the facts speak for themselves that he got away in a democratic South Africa for not being held accountable for my uncle's death at the TRC as well as post the TRC and that's an absolute tragedy," said Timol's nephew Imtiaz Cajee.

He said the family wanted Rodriques to tell the truth about what really happened to Timol after his death was declared a suicide in 1972.

"We got nothing from him, we got denialism, taking no responsibility and dragging the criminal case from commencing," added Cajee.
