The Helen Suzman Foundation has turned to the high court to challenge the process followed around government’s Covid-19 regulations.

The foundation believes the Disaster Management Act bestows too much power in the hands of the Minister of Cooperative Governance Nkosazana Dlamini-Zuma.

It has filed court papers seeking an order directing both Parliament and the executive to take steps to ensure that they “reclaim and restore the respective powers of parliament and the executive”.

"Parliament effectively is not running the country and it is not doing the oversight that it should be doing of the executive, because the legislative functions are being carried out by the minister and the (coronavirus) command council and this is not in line with our constitution," says the foundation's Francis Antonie.

He says the while foundation is not challenging any of the Covid-19 regulations, it believes the regulations should be approved by Parliament.
