Labour Court dismisses Numsa’s bid to appeal congress interdict
The
Labour Court has dismissed the National Union of Metalworkers of South Africa’s
application for leave to appeal an interdict against its national congress.
Last week, the court granted unhappy leaders and members of the trade union an urgent interdict to stop the congress until Numsa fully complies with the terms of its own constitution.
The application was brought by Numsa’s suspended second deputy president Ruth Ntlokose and 30 other officials.
Following the court order, Numsa claimed its Central Committee had amended the constitution to allow the congress to go ahead.
But the Labour Court disagreed during a sitting on Wednesday evening.
Numsa president Andrew Chirwa says they are going to appeal the ruling.
“We are not pulling back, this is not the end for us. We’re going to challenge the judge. The union is going to consider approaching Labour Court directly and appeal.
“We’re not backing down on this judgment. We believe there are legal avenues that the organisation has to discuss and consider.”
