Mkhwebane loses bid to rescind judgement on impeachment process
Public Protector Busisiwe Mkhwebane has lost yet another bid to halt an inquiry into her fitness to hold office.
The Constitutional Court has ruled against Mkhwebane's application to rescind the judgment that cleared the way for an impeachment process against her in Parliament.
On Friday the apex court found there was no basis for Mkhwebane's application.
"There are also no exceptional circumstances that warrant the rescission of the judgment," the court said in a ruling.
"Therefore, the court has concluded that the application should be dismissed as no case has been made out for rescission."
Earlie this year, Parliament resolved to resume the impeachment proceedings against Mkhwebane after the apex court found that there was a prima facie case that Mkhwebane committed misconduct.
Mkhwebane would be the first head of a Chapter 9 institution to face an impeachment process.
The process was set in motion by the Democratic Alliance in 2020.
The official opposition party submitted a 7000-page document detailing evidence on Mkhwebane's inability to hold office.
