Modise suspension would be premature, says Moya

The deputy mayor is under pressure for allegedly failing to disclose his business interests with the city.


Last week, a forensic investigation found that Modise failed to disclose his financial interests in Triotic Protection Services, a private security firm contracted to the city.


Modise, who is an ANC councillor has maintained his innocence, saying the contract was awarded before he became a councillor in February 2023.


The report was tabled in council, which voted to establish an ad hoc committee to consider the next steps. However, the move has been rejected by the DA calling for Modise to be dismissed from the executive.


The DA will open a case of fraud against Modise on Wednesday.


"The multi-party committee is going to look at the outcomes or the findings and recommend an appropriate sanction. So, in the next couple of months that committee will sit and make sure that they bring the report back to council,” Moya told a media briefing on Tuesday. 


"Until then, it will be premature for anybody to be talking about suspending because it's that committee that will come back and advise council what is the appropriate step." 


Moya explained that Modise faces three potential sanctions if found guilty.


"Should a councillor be found to be guilty of contravening the code of conduct. Firstly, is that you can issue a warning. Secondly, you can fine the councillor. Thirdly, you can recommend to the MEC of Cooperative Governance and Traditional Affairs that you want the councillor removed."
