Musician could flee: State

Rape accused musician Sipho Charles Ndlovu has no fixed address and can easily flee the country, the Roodepoort Magistrate's Court heard on Monday.

"No one is certain where the accused lives, he has submitted two addresses, nothing ties him to a specific place... he has no property registered in his name," said prosecutor Willem Le Roux.

Ndlovu, who performs under the name Brickz, has been in custody since November 1 for allegedly raping a 17-year-old girl in March.

In an affidavit submitted as part of his bail application, Ndlovu denied raping the girl and indicated he intended pleading not guilty.

The State is opposing his bail application.

Le Roux said Ndlovu could easily cross the border into neighbouring countries even without a passport, if he were to be granted bail.

The award-winning Kwaito star wore a black shirt and a cream white jacket and listened attentively to Le Roux.

Ndlovu did not disclose all his income, Le Roux said.

He had stated in his affidavit that he earned R15,000 income a month from performances.

"He is well known and his music is played all over the radio stations and television. He sells CDs and derives an income from that... the accused is quiet on this matter."

Le Roux said Ndlovu could also pose a danger to the victim and his wife if released on bail.

Rape was a serious charge and if convicted, Ndlovu faced a minimum 10-year-sentence, said Le Roux.

The bail hearing continues.
