Ramaphosa: Mkhwebane report ‘fundamentally and irretrievably flawed’

President Cyril Ramaphosa says he will take the report by Public Protector Busisiwe Mkhwebane on an urgent judicial review.

Ramaphosa addressed the media at the Union Buildings in Tshwane on Sunday evening.

The president said Mkhwebane’s findings against him are of serious nature and cannot be taken lightly.

On Friday, the public protector found that Ramaphosa deliberately misled Parliament about the R500 000 donation made for his African National Congress (ANC) campaign.

She also found him guilty of violating the executive ethics code


But Ramaphosa believes the report is fundamentally and irretrievably flawed.

“The report contains numerous factual inaccuracies of a material nature. The findings were found are wrong in law, are irrational and in some instances exceed the scope of the powers of the public protector,” says Ramaphosa.

Ramaphosa added that by failing to afford him an opportunity to comment on the proposed remedial action, Mkhwebane violated the provision of the Public Protector Act, the Constitution and the principles of common law.

“I have therefore decided to seek an urgent judicial review of the public protector’s report, its findings and its remedial action.”
