Former crime intelligence boss Richard Mdluli says he will approach the Supreme Court of Appeal in Bloemfontein to fight his five-year prison sentence.
On Tuesday, he and his co-accused were sentence to an effective five years behind bars by the high court in Johannesburg following their earlier conviction of kidnapping and assault.
He also lost his application for leave to appeal.
The matter relates to the kidnapping and death of Oupa Ramogibe, who was married to Mdluli's former lover Tshidi Buthelezi.

"I have said that I respect the law and what the judge has done but I have every right to go to any court,” Mdluli said.
“We will petition the Supreme Court of Appeal because we are aware of there are a log of gaps which were supported and dealt with but we were failed."
Mdluli maintains he was never supposed to be convicted and sent to prison.
