SABC workers dealt yet another blow following failed court bid by union

The Labour Court in Johannesburg has dismissed an application for leave to appeal a previous ruling that the retrenchment process of the South African Broadcasting Corporation (SABC) is fair and just.
The court ruled in favour of the SABC’s plans to retrench some 300 employees.
In December, the court dismissed an application by the Broadcasting, Electronic, Media and Allied Workers Union (Bemawu) to declare the Section 189 process as irregular.
The union believed the apex court erred after dismissing the Bemawu’s bid to have the redundancy letters and retrenchments retracted.
Bemawu then applied for leave to appeal, which was denied.
The Labour Court found that there were no reasonable prospects of success that another court could come to a different conclusion.
The embattled state-owned entity’s COO Ian Plaatjies welcomed the ruling of the court stipulating that “the whole process must end”.
“The Labour Court has therefore once again validated the SABC’s section 189 process as being procedurally fair and that all participating stakeholders were afforded ample opportunity to engage meaningfully.
