Sibiya is set to appear before the hearing with his employer, the South African Police Service (SAPS), on Monday, despite being in custody at the Kgosi Mampuru II Correctional Centre in Pretoria pending his bail application.

This was revealed by his lawyers in the Randburg Magistrates Court on Friday, where the 59-year-old appeared on charges of rape, human trafficking, and the alleged sexual grooming of teenagers in Sandton.

The disciplinary proceedings relate to allegations against the senior cop that emanate from the Madlanga Commission of Inquiry.

The commission, which was recently granted an extension to March next year, is probing corruption, political and criminal interference within the country's criminal justice system.

Sibiya was suspended in July last year following claims that he interfered with over 120 case dockets from the KwaZulu-Natal Political Killings Task Team.

His lawyer, Advocate Estelle Killian, said her client had been issued with three disciplinary hearing notices.

"There is an application being prepared to seek a postponement on Monday. The applicant is not in a position to proceed with the hearing," said Killian.

"In the event that the application is declined, there will be an urgent application to the Labour Court for a directive, which will be done by way of application and not by way of evidence of the applicant,” she added.

The first of the three hearings is scheduled to take place in November, and it relates to his alleged involvement in the moving of the PKTT dockets from KZN to Pretoria.

The second hearing relates to the allegations made at the Madlanga Commission.

National police spokesperson Athlenda Mathe confirmed that it would be an expeditious hearing, chaired by the newly appointed commissioner of the Limpopo SAPS, Jan Scheepers, and is scheduled for Monday, 05 October.

The last notice was filed this week, and it relates to the criminal charges Sibiya is facing in the Randburg Court. No date has been given for this process.

Meanwhile, Sibiya’s bail application hearing has been postponed to next week following the cross-examination of the investigating officer.
