LISTEN: State capture cases among top priorities for new NPA head Andy Mothibi

The newly appointed National Director of Public Prosecutions, Advocate Andy Mothibi, has assured South Africans that the National Prosecuting Authority will continue to prioritise cases from the State Capture Commission.
Speaking at a South African Police Service media briefing in Pretoria on Friday, Mothibi said attending to these cases remains a key focus.
He acknowledged that some cases had not received sufficient attention in recent years.
According to the latest progress report on implementing actions arising from President Cyril Ramaphosa's response to the State Capture Commission recommendations, the NPA is actively pursuing 218 criminal investigation recommendations.
“As of March 2025, 21% of these cases were either finalised or enrolled for trial. Just over half were under active investigation.
"Several high-profile cases are scheduled for trial through 2025–2026, including matters related to the Free State asbestos removal case, SA Express, Bosasa-related cases, and Transnet contracts,” the report stated.
Mothibi confirmed that several state capture cases are already in court, including investigations into irregularities and corruption at Transnet.
“Several former executives and former executive authorities have been charged and are currently in court.
"We are aware that the public wants to see results, and we will ensure that these cases receive effective prosecution, with the aim of obtaining convictions and appropriate sentences,” Mothibi added.
The prosecutions head also highlighted the Nugent Commission matter, in which the Constitutional Court ruled in favour of the NPA.
He confirmed that the case will be enrolled to ensure it takes its course, a ruling he said vindicates the NPA and the Investigating Directorate , which was formed to focus on State Capture Commission cases.
"There are other cases being worked on, and I have been assured by the Investigating Directorate Against Corruption team that they are actively ensuring these matters are enrolled. We will announce these cases as and when they are enrolled in court,” he said.
SAPS Investigations and Task Team
At the briefing, National Police Commissioner Fannie Masemola announced that investigations into SAPS members implicated by the Madlanga Commission of Inquiry are at an advanced stage.
Some members have been suspended, while others have received notices of intended suspension.
Masemola also confirmed the establishment of a specialised task team to investigate SAPS members implicated at the inquiry.
The team is composed of skilled detectives, forensic experts, crime intelligence analysts, and operatives, with members of the NPA embedded to provide prosecutor-guided investigations.
The aim is to ensure evidence is properly gathered, assessed, and acted upon, leading to effective prosecutions.
“We continue to assess and review the safety and security of those involved in the commission,” Masemola said, adding that the task team will take over all referrals from existing investigations and begin its work next week.
NPA and Law Enforcement Collaboration
Mothibi emphasised the collaboration between the NPA and law enforcement agencies, noting that state advocates and prosecutors are permanently allocated to the task team.
The Asset Forfeiture Unit will also support the investigations as required.
“This approach is critical to upholding the rule of law, ensuring swift justice, and holding those responsible for criminality accountable, reinforcing the principle that no one is above the law,” he said.
"Aside from implementing Madlanga Commission recommendations, the NPA will continue prioritising organised crime, extortion, gender-based violence, and corruption matters.
"A focused media briefing on NPA priorities will be hosted in the coming weeks," he added.
