'Shifting the narrative of fatherhood': New parental leave ruling in SA explained

South Africa's Constitutional Court has made history by granting equal parental leave to all parents.

On Friday, 3 October, South Africa's Constitutional Court made history by granting equal parental leave to all parents, regardless of gender, sexual orientation, or family structure.

This ruling replaces "maternity leave" with "parental leave," allowing both parents to share four months of leave as they choose.

Breakfast with Martin Bester spoke to Onyi Nwaneri, Managing Director at Sesame Workshop International South Africa, to get a better understanding of the new ruling.

According to Nwaneri, this is more than a legal change; it's a bold step toward true gender equality and recognition of diverse families.

The new legal framework and community commitments are shifting the narrative of fatherhood from "just a provider" to an active nurturer and partner.

The new law does not take time away from mothers but rather gives families the freedom to choose how best to care for their children.

"Both parents can now share four months of leave, reflecting the reality of diverse families and modern caregiving."

"When fathers step up as caregivers, mothers gain more freedom to pursue work, education, and personal growth."

"Shared caregiving strengthens families and supports women’s economic participation."

The impact on fatherhood

Research over the years has shown that children with involved fathers, whether biological or not, tend to do better emotionally, socially, and academically.

"Children with engaged fathers have better educational, emotional, and social outcomes, and families are stronger and more resilient."

In South Africa, most children live with men who are not their biological fathers.

"Social fathers," which include uncles, grandfathers, coaches, and mentors, play a vital role in nurturing and supporting children.

"When fathers are empowered to care, women’s economic participation rises, children thrive, and society moves closer to equality."
