The Socio-Economic Rights Institute of South Africa and Legal Resources Centre, who represent the families, say they have written to the President asking him to release the report by June 1.

They have also asked Judge Ian Farlam to release it by June 2 if the President fails to do so.

This comes after President Jacob Zuma announced during the Presidency Budged Vote in the National Assembly on Tuesday that he will release the report by the end of June.

SERI researcher Naadira Munshi says Judge Ian Farlam has the powers to release it.

“Judge Ian Farlam has the powers to release the report 14 days after he has given it to the president. Regulation 15 of the Procedural Regulations establishing the commission provides that,” she says.

Opposition parties have reacted strongly, asking the President to release the report.

The legal representative of Amcu, the injured and arrested miners, Andries Nkome threatened to take the matter to the Johannesburg High Court since the President did not release the report on May 24.

Nkome said they will have a clear indication of what the miners want to do going forward on Wednesday afternoon after the President’s announcement in the National Assembly on Tuesday.

Munshi says the President has had enough time to consider the report.

“It has been three years and there is a lot at stake, especially the civil claims for the families,” she says.
