ANC will go all the way to ConCourt in battle over MK logo, name - Mbalula

ANC Secretary General Fikile Mbalula says the party is willing to go to the Constitutional Court to fight for the name and logo of uMkhonto weSizwe.

The party is engaged in a legal battle with former president Jacob Zuma’s uMkhonto weSizwe party over the name and logo of the ANC’s disbanded military wing. 

The ANC has been granted leave to approach the Supreme Court of Appeal following an earlier ruling in favour of the MK party. 

The ANC sued former president Jacob Zuma's newly formed MK Party, accusing it of violating trademark laws by using a name and logo similar to uMkhonto weSizwe.

Mbalula briefed the media on the party's National Executive Committee lekgotla on Thursday.

“When Jacob Zuma speaks about that party of his, he does not refer to his own history. He talks about the history of the liberation struggle and of uMkhonto weSizwe and that uMkhonto weSizwe is right at the centre of the liberation struggle and the ANC.

“What will we say to generations to come that we allowed one former president to just steal? We will chase this thing up until the apex court,” vowed Mbalula.

 The court initially dismissed the ANC’s application, stating it was not urgent and should have been directed to the Electoral Court.

The MK Party argued that the logos are not the same, urging the ANC to accept the ruling.

However, the ANC contended that the MK party's use of the logo in future elections would undermine the goodwill associated with the uMkhonto weSizwe name.

In a judgment delivered on Thursday, Durban High Court Judge Mahendra Chetty found that there is a reasonable prospect that another court might arrive at a different conclusion.
