Application against Vosloorus taxi rank probe dismissed

The Special Tribunal has dismissed an application by a construction firm against the Special Investigating Unit’s probe into the alleged issuing of fraudulent invoices during the construction of Vosloorus Taxi Rank.

In February 2014, Kubwa Kazi Construction and Lebaka Construction were awarded an R17.8 million tender to construct Vosloorus Taxi Rank.
During its probe into the awarding of the tender, the SIU found evidence of fraud, including an alleged fake invoice for R1.97 million submitted by Kubwa Kazi Construction to the municipality, falsely claiming payment for materials that were never delivered.
SIU spokesperson Kaizer Kganyago said the counterclaim was also against the Ekurhuleni metro.
"Instead of responding to the SIU’s civil litigation application, the service providers launched a counter-application for a claim to receive payment from the municipality for another project.
"In its judgment, the Special Tribunal dismissed the counterclaims, stating it had no authority to deal with those claims because they were unrelated to the SIU’s efforts to recover money lost to fraud.
"The investigation also uncovered collusion among the defendants, who prepared and submitted fake documents to get money from the municipality that they were not entitled to. Some of the defendants admitted they knew about these false claims,” he added.
The application was dismissed with costs.
