Brakpan boy (12) in court for fatal crash with ‘stolen’ car

A 12-year-old boy who ran over and killed a 14-year-old in Brakpan appeared in the local magistrate’s court on Monday.

He is facing a charge of culpable homicide and driving a motor vehicle without a license.

The boy was arrested on Saturday after he skipped a stop sign and ran over the 14-year-old. 

“It is alleged that on 7 June 2025, the minor was driving his parents’ vehicle at the corner of Madeley and Northdeene Street when he drove over a 14-year-old boy and bumped into a wall.  The 14-year-old boy sustained injuries and was declared dead on the scene,” said the NPA in Gauteng, Lumka Mahanjana.

“The 12-year-old was then taken to the Brakpan charge office and later released into the care of his parents by police.”

The matter was postponed until August to determine his criminal capacity.

Meanwhile, a child clinical psychologist, Lynette Roux, says it will take a lot of psycho therapy for the 12-year-old to come to terms with the events of the weekend.

She added that children under 12 are considered to lack criminal capacity, while courts only allow 14-year-olds to stand trial.

"It will take a lot of psychological assessments to ascertain whether or not this child lacks criminal capacity of a 12-year-old."
