EFF marches to ConCourt for Phala Phala case

Members of the Economic Freedom Fighters marched to the Constitutional Court on Tuesday ahead of the party's application on the Phala Phala saga.

The EFF turned to the apex court to seek a ruling against the decision by the National Assembly not to adopt the findings of the Independent Panel Report, led by Judge Sandile Ngcobo. 

The report found prima facie evidence suggesting President Cyril Ramaphosa had a case to answer about the millions of US dollars discovered at his Phala Phala farm in Limpopo. 

The march, which began at Mary Fitzgerald Square in Johannesburg, will culminate in a picket outside the court.

Speaking to the media on Monday, EFF leader Julius Malema vowed to keep the Phala Phala issue in the spotlight.  

“For as long as the EFF is in Parliament – whether you like it or not – we will continue to bring up the Phala Phala matter,” Malema said, emphasising that the party’s 39 members will ensure the issue remains an issue of debate for the next five years.  

Malema also said that the MK Party would not be allowed to participate in the march, despite its similar stance on Phala Phala.  

“We are marching to the Constitutional Court with everyone except MKP. If they want to march, they must organise their own. It’s our march. But any other individual or party opposed to Phala Phala is welcome to join,” Malema clarified.  

In its court application, the EFF argues that the National Assembly acted irrationally by blocking further investigation into the prima facie findings of the Independent Panel.

 The party claims that the Assembly disregarded the report’s conclusions without providing a factual or legal basis for doing so. 

The EFF further alleges that the ruling party used its numbers in Parliament to shield Ramaphosa from accountability, effectively undermining Parliament’s constitutional mandate to hold the President accountable.  

The National Assembly previously voted against adopting the Section 89 Panel Report.
