The elite-crime fighting unit has subpoenaed the power utility to handover specific documents that form part of the investigation at the embattled SOE.

Parliament's Portfolio Committee on Public Enterprises has heard testimony during its probe that some of the documents might have been shredded.

"That is also something that we picked up yesterday but we were very much content to say that if there are any people who are involved in such activities, more specifically looking at the documents that we have requested, and it is found that people have shredded documents we will have to follow legal due processes to make sure those responsible is taking to court," says Hawks spokesperson Hangwani Mulaudzi.

Mulaudzi insists those guilty will face charges including defeating the ends of justice.

"We served Eskom with the subpoenas at the beginning of the year, in January, and we have been in constant contact with their legal team. We expect the documents to be delivered possible by the end of the week."

Last month, the Hawks conducted a search and seizure raid at the Bloemfontein office of Free State Premier Ace Magashule, as well as the offices of the province's agriculture department.

"If there are individuals that have been involved that are involved in any corrupt activities, they will be arrested. It is critical that even before we go to court that we should have a watertight case so if there are people that need to be arrested. We are not going to be shy."
