Hlophe ruling a 'travesty of justice' - MKP

The uMkhonto weSizwe Party has described Monday’s ruling on former judge John Hlophe as a travesty of justice.

The Western Cape High Court found Parliament’s decision to appoint the impeached Hlophe to the Judicial Service Commission as unconstitutional.
On Monday, the court found that the National Assembly failed to properly exercise its discretion, undermining the integrity of the judiciary.
Hlophe, the MK Party’s deputy president, was nominated last year but later resigned.
"The decision to elect Dr Hlophe as a member of the JSC was by duly elected representatives in the National Assembly as per the powers and privileges of Parliament, drawn from the constitution," said the MKP’s spokesperson Nhlamulo Ndhlela.
"Therefore, the decision by the Western Cape High Court is a travesty of justice and totally unconstitutional.
"It cannot be that the unelected judges who are not lawmakers but interpreters of the law, allow a racist minority to subvert the will of the people,” he added.
