Investigating Directorate lodges appeal against Nulane acquittals

The Investigating Directorate on Tuesday announced that it lodged an application to appeal a High Court judgment on the R24.9 million Gupta-linked Nulane matter.

Last month the High Court in Bloemfontein dropped charges against accused Limakatso Moorosi in the R24.9-million fraud and money laundering matter.
This was the first major Gupta-linked state capture case from the NPA to reach the trial stage.
Acting Judge Nompumelelo Gusha acquitted Gupta associate and Nulane director, Iqbal Sharma, his brother-in-law, Dinesh Patel, executive, Ronica Raganva, three former Free State government officials as well as Dr Limakatso Moorosi.
Gusha said the State had failed to prove that the money that flowed out of the government landed in the accounts of the accused.
“The application is for leave to appeal the 21 April 2023 judgment that granted seven accused discharge in terms of Section 174 of the Criminal Procedure Act 51 of 1977(Act). The application is also based on the 23 February 2023 verdict that rendered key documents and exhibits provided by the state inadmissible as evidence against the accused,” said ID spokesperson Sindisiwe Seboka.
If the application to appeal is granted it will be heard by a full bench of the Bloemfontein High Court or the Supreme Court of Appeal.
