The uMkhonto Wesizwe Party has expressed concern over the “uneven application of justice” towards its members following the arrest of former Transnet executives Brian Molefe and Siyabonga Gama.

The two MKP MPs handed themselves to the police on Monday morning before appearing in the Palm Ridge Magistrate’s Court.

The allegations against the former executives relate to a 2015 tender for the procurement of 1,064 locomotives as part of a broader R54 billion contract plagued by irregularities and alleged violations of the Public Finance Management Act.

Speaking through their advocates, Molefe and Gama stated their intention to plead not guilty.

MKP spokesperson Nhlamulo  Ndhlela said while they understand that the law must be applied without fear or favour, the party is concerned over a targeted campaign against MKP members who previously held prominent roles in state-owned enterprises.

“As a party, we have always called for transparency and accountability, including in the structures of the party itself,” said Ndhlela.

“It is evident that when uMkhonto Wesizwe tries to hold institutions to account, particularly those captured or influenced by narrowed political interests, there is a troubling pattern of retaliation.”

Ndhlela said he hopes the case against Molefe and Gama will be fair and free from political interference.

Meanwhile, the state said it would not oppose bail, as the duo would not pose a flight risk.
