Rumours of new SA law for cheaters debunked

Rumours have been circulating on social media about a new law that would make cheating on your spouse a criminal offence in South Africa.

It's never ideal to be on the end of a failed marriage, especially when the reason behind the ending is infidelity.
Rumours about a new law that would take effect in 2026 have been flying around social media. It claims that cheating partners who are legally married could receive jail time if there's proof of their adulterous behaviour.

However, a recent news News24 article revealed that the alleged 'law' for cheaters does not exist.
Speaking to a local attorney, the news site reported: "South African attorney Kgaogelo Modisakeng clarifies that infidelity is grounds for divorce but not a criminal offence under the country’s current legal system. Modisakeng, an admitted attorney at SK Ntsumela Attorneys in Cape Town, has firmly dispelled these claims."
For those of who thought you could have your partner jailed for cheating, we are sorry, these claims are baseless. Understandably, adultery or infidelity can cause immense emotional pain, but while that may be grounds for divorce, it doesn't amount to jail time.
Some South Africans are irate over the alleged legislation regarding cheating partners, saying that more attention should be given to things such as gender-based crime and corruption.
