This appearance also relates to comments he made to EFF supporters about land occupation.

Malema appeared in the Bloemfontein Regional Court where the case was postponed until 5 June 2017.

In a similar argument in Newcastle last week, Malema wants to challenge the constitutionality of the Riotous Assemblies Act of 1956.

Afriforum brought the case in Bloemfontein, with spokesperson Kallie Kriel saying Malema can't make public statements that go against the constitution.

"We have a lawlessness problem in the country at the moment. We have a spike in violent crime and, therefore, we need politicians to make sure that they set a good example. What Julius Malema is doing is he's showing disregard for the law and the constitution. We need to make sure that a strong message is being sent out that nobody in this country can incite people to commit a crime," says Kriel.

Meanwhile, one of the Fees Must Fall leaders and student activist, Mcebo Dlamini is adamant that land needs to be given to black South Africans.

"We remain fugitives in our own country without land. With the degree that we have...they are nothing without the land. Where are you going to stay once you are a professor? In the sky? And there is no free education without the land. These things go together," says Dlamini.
