Aarto Act presumes guilt, claims JPSA

Justice Project South Africa chair Howard Dembovsky believes the Administrative Adjudication of the Road Traffic Offences (Aarto) Act makes a presumption of guilt.

Dembovsky briefed media in Tshwane on Tuesday on his high court application in which he challenges the constitutionality of certain provisions of the Aarto Act.
"The primary issue which I have with the Aarto Act is the particular presumption of guilt until you prove yourself innocent, " he said.
It's been two years since Dembovsky launched the high court application.
However it is still not known when the matter will be heard, even though the Aarto Act is meant to come into effect in June.
Dembovsky said they will wait for the Judge President to determine if the matter is serious enough to be heard.
