Abrahams’ future as NPA head set to be decided

The Constitutional Court is expected to rule on Monday whether Shaun Abrahams’s appointment as the head of the National Prosecuting Authority is valid.

Abrahams was appointed as the head of the National Prosecuting Authority (NPA) after former prosecutions head Mxolisi Nxasana was induced to leave the office by former president Jacob Zuma.

 

The lower courts found that the R17.3 million golden handshake deal given to Nxasana to leave office was unconstitutional.

 

Executive Director of Corruption Watch, David Lewis says the judgment is expected to confirm the removal as unlawful.

 

"Then Shaun Abrahams will no longer occupy that position because he was appointed to fulfill a position that was never vacant," says Lewis.

 

Corruption Watch has asked the court to remove Abrahams and reappoint Nxasana. 

 

Lewis believes that Abrahams is unfit to hold office.

 

"This case has been about the unlawfulness of removing his predecessor Mr. Nxasana from office. That is an important legal step on its own." 

 

He believes Nxasana was forced to vacate his office by former President Jacob Zuma and his cronies.
