AfriForum to appeal High Court ruling on Section 25
Updated | By Karabo Tebele
Lobby group AfriForum says it will appeal a Western Cape High Court ruling on the constitutionality of the process to review section 25 of the Constitution.
The court dismissed the application on Wednesday, finding that it would not the in the interest of justice to grant the application.
The lobby group wanted to challenge a previous judgment on the expropriation of land without compensation, but the court found the matter to have been moot as it has been overtaken by event.
Parliament is in the process of reviewing section 25 of the Constitution that seeks to expropriate land without compensation.

AfriForum’s Ernst Roets says they believe the court ignored the content of the application.
“We are concerned about the judgment. We believe that it is an important issue, especially given that several hundred thousand peoples’ submissions were just discarded and were not considered in the decision of the parliamentary commission regarding expropriation without compensation.
“So, we will study the judgment and then we will make the decision as to whether we will go to the Supreme Court of Appeal.”
Roets says the ruling must be appealed in order to halt the amendment of section 25.
“There are still public hearings on the issue and AfriForum will continue its fight through participating in the public gatherings and through other legal measures we can take. Also through a campaign, in other words getting international support and lobbying people to take a stance against it.”
