AKA murder: Ndimande brothers’ extradition case postponed to July

The case against the two Ndimande brothers, Siyabonga and Malusi, was postponed to July by the Manzini Magistrate’s Court in Eswatini.

They have been linked to the murders of Kiernan ‘AKA’ Forbes and Tebello ‘Tibz’ Motsoane outside a restaurant in Durban in February 2023.

The case was postponed on Friday after their lawyer, Sivesonkhe Ngwenya, continued to raise concerns about the State's refusal to provide full disclosure of the docket in its extradition application.

The brothers are part of the group of seven men linked to the murder of Forbes and Motsoane.

The duo was arrested in the capital, Mbabane, in March.

They are facing charges of murder, attempted murder, and conspiracy to commit murder.

Ahead of the postponement, Magistrate David Khumalo warned the legal teams to have their papers in order for the next court date.

“It has since been agreed that the representatives will file the answering affidavit on 18 June and the respondents will file their reply affidavit before 25 June, and that on 28 June, the respondents are going to file their heads of arguments and the applicants will file their own on 3 July for the matter to be argued on 5 July. So the matter is being postponed until then.

“The court will not be accepting excuses for the matter not to be argued on that date or for failure by any of the parties to file its papers timeously,” added Khumalo.
