The lobby group applied to the High Court in Cape Town to interdict Parliament from adopting the report of the constitutional review committee, which recommended the amendment of Section 25 of the Constitution to allow for the expropriation of land without compensation.

The party says it is vindicated by the ruling and has described the application by the lobby group as a ploy to “justify the violent dispossession of land”.

“The ANC has always stated that this application was nothing but a desperate attempt to delay Parliament from responding to the quest of our people for the expropriation of land in the public interest,” says the ANC’s spokesperson in parliament, Nonceba Mhlauli.

AfriForum’s  CEO, Kallie Kriel, maintains the ruling is not the end of the road and that the ruling was merely on the matter of urgency.

“But the second part of our court application can go ahead, we still believe we have a very strong case.”

Kriel believes the fight against the amendment of Section 25 is a pivotal one for all South Africans as the country could end up like Zimbabwe and Venezuela.

The commission’s report is scheduled for consideration and adoption by the National Assembly and the National Council of Provinces on Tuesday.
