Judgment will be handed down for the case between the ANC's suspended secretary-general, Ace Magashule, and the party's president, Cyril Ramaphosa, by the Gauteng Division of the High Court in Johannesburg on Thursday.

Magashule wants the High court to declare the so-called "step aside rule" by the party's National Executive Committee (NEC) to be declared unlawful, invalid, and unconstitutional.

He wants his suspension to be lifted, and he is also asking the court to back the letter of suspension that he sent to Ramaphosa.

The judgment comes in a week where Magashule's political alliance suffered a number of setbacks with former president Jacob Zuma sent to prison, and the Magashule-aligned Carl Niehaus arrested for contravening lockdown regulations for allegedly organising a gathering in support of Zuma.

Ramaphosa, on the other hand, has been bolstered by the Constitutional Court's ruling setting aside a report by Public Protector, Busisiwe Mkhwebane, which found that Ramaphosa misled Parliament on the R500 000 donation made by Bosasa to his ANC presidential campaign.

The handing down of the judgment will take place virtually and is scheduled for 10am on Friday.
