ANC's ‘step-aside’ resolution unconstitutional - law expert

Law expert Ulrich Roux believes there are merits to the legal challenge by Ace Magashule against the African National Congress (ANC).
This comes after governing party’s secretary-general filed court papers in the High Court in Johannesburg to set aside his suspension.
He believes the step-aside resolutions, which was agreed upon as the party’s national conference in 2017, is unlawful.

Roux says the party's step-aside resolution is not in line with the constitution of the country.
"Which confirms that a person is of course innocent until proven guilty in a court of law.
"His application that has merit, in my opinion, in that all laws and regulations in South Africa must be in accordance and must be inline with the constitution," says Roux.
