Application to have Abrahams suspended struck off roll
The Helen Suzman Foundation (HSF) and Freedom Under Law's (FUL) urgent application to have NPA head Shaun Abrahams suspended has been struck off the roll in the North Gauteng High Court.
A full bench of High Court judges heard the matter.
"This application is struck off the roll for lack of urgency, with costs," says Judge Dunstan Mlambo.
The HSF and FUL want President Jacob Zuma to suspend Abrahams.
It relates to the withdrawal of the case against Finance Minister Pravin Gordhan and two other SARS officials.
"We should guard as a court against creating precedents, where based on insufficient grounds and inadequate foundation, to encourage ordinary citizens to use the courts as a platform to dictate to the executive how it should do its work. There is more than ample judicial authority that deals with the type of matter that can justifiably be brought for urgent relief in the court of law. This case is not one of them," says Mlambo.
After calls from the organisations, President Zuma wrote to Abrahams and two other senior advocates to make submission as to why he shouldn't suspend them.
The organisations spoke to the media after the ruling.
