Atul Gupta is playing the victim
Updated | By Nathan Daniels
In a responding affidavit by the Asset Forfeiture Unit (AFU), it suggests that the Gupta brother might be playing the victim after he said that law enforcement agencies did not follow due process.
The Asset Forfeiture Unit says the recent claims by Atul Gupta, that he, among other things, never received correspondence from law enforcement agencies, are lies.
The AFU has opposed an application by Gupta to have a preservation order obtained against him set aside.
He argues that authorities did not follow due protocol and process when it applied for the order.
In his affidavit, Gupta claims authorities "not only failed to make out a case for relief sought", but also misled the court with the evidence which led to the order being granted.
The AFU has responded, accusing Gupta of fraud, money laundering, and theft.
Acting Special Director of Public Prosecutions, Motlalekhotso Molelle wrote in the court papers that he finds the order to set aside "baffling".
Molelle wrote adamantly that Atul Gupta obtained the R10 million through proceeds of unlawful activities and it is therefore incorrect and misdirected to claim otherwise.
The case is set to be heard in Bloemfontein on 1 March .
