Carl Niehaus to sue state after Covid case dismissed

The Estcourt Magistrate’s Court has acquitted suspended ANC member Carl Niehaus on charges related to the contravention of Covid-19 regulations.
Niehaus was arrested on live television after addressing a group of people outside the Estcourt prison, allegedly in contravention of the Covid-19 regulations.
The group was protesting against the imprisonment of former president Jacob Zuma in July 2021.
He says the charges were politically motivated and amount to an abuse of power by authorities.
"I was evidently specifically targeted with selective persecution; this is nothing less than a travesty of justice. Such abuse of power and misusing the resources of the State for nothing more than party political and narrow factional interests.
"I have therefore consulted with Advocate Dali Mpofu, and I am grateful that he has accepted to act on my behalf in order to sue the State for wrongful arrest and malicious prosecution. I will immediately file these charges against the State."
KwaZulu-Natal National Prosecuting Authority spokesperson Natasha Kara said the court ruled in favour of Niehaus in his application for a discharge which was granted.
