ConCourt to hand down Tlokwe judgement

The Constitutional Court was expected to hand down a judgment on Tuesday that would determine whether the local government elections can go ahead in August as planned.
The independent electoral commission made an urgent application to the highest court in the land earlier this year to have an electoral court decision, regarding the voters roll, set aside.
Addresses for some 4000 voters could not be verified by the IEC and the initial case against the IEC was brought by six independent candidates from Tlokwe in the North West.
Voters complained that the electoral authority had failed to provide them with a complete voters roll.
The court case over contested by-elections in Tlokwe has revealed the possibility that the IEC may have misinterpreted its duty under the Electoral Act to obtain and record the addresses of registered voters.
The IEC told the Constitutional Court earlier that if the duty in section 16 meant it had to obtain and record the addresses of all voters — whenever they were registered — the coming election would not be able to proceed.
