Constitutional Court rules in favour of Jiba, Mrwebi

The Constitutional Court has dismissed an application by the General Council of the Bar to have Nomgcobo Jiba and Lawrence Mrwebi struck off the roll of advocates.

In April, the pair was axed from the National Prosecuting Authority (NPA) by President Cyril Ramaphosa, after a recommendation by the Mokgoro inquiry into their fitness to hold office.

 

The high court in Pretoria had ruled in favour of the bar to have Jiba and Mrwebi struck off the roll of advocates for their conduct in several prosecutions which failed during their time at the NPA, including the fraud and perjury case against former crime intelligence head Richard Mdluli.

Jiba and Mrwebi appealed the high court judgment at the Supreme Court of Appeal and won.

 

Justice Chris Jafta announced the unanimous decision by the highest court in the land on Thursday.

 

He said the applicant failed to establish whether this matter falls with the jurisdiction of the court and that the bar did not seek to protect a constitutional right.

 

Jiba's lawyer Zola Majavu said while his client welcomed the ruling, she feels she has been targeted because she is a black woman.

 

He said while it vindicates his client, she is aware that this is the beginning of another long journey as she plans to challenge the Mokgoro report.
