Court hears: 'There is no doubt Ramaphosa misled Parliament'

The legal team for the Public Protector argued on Tuesday that there is no doubt that President Cyril Ramaphosa had misled Parliament.

Ramaphosa is challenging a report by Public Protector, Busiswe Mkhwebane, into the R500 000 donated by Bosasa and into his "CR17" Presidential campaign.

In the report, Mkhwebane found that Ramaphosa misled Parliament when he initially said the money was donated to his son Andile's foundation in a reply to former DA leader Mmusi Maimane. 


Counsel for Mkhwebane, Muzi Sikhakhane, told the court that Ramaphosa's lawyers have no basis for saying he did not mislead Parliament. 


"The President was at liberty to say 'I do not know those facts, I will mislead Parliament if I try to answer your question Mr. Maimane.' He should have said that he could have said that. The rules protect him from answering a question like that precisely because he must not say something factually incorrect in the National Assembly," argued Sikhakhane.


Sikhakhane said the assertion that Ramaphosa was given the impression that the donation did not go to the CR17 account was false as he stated in his reply in Parliament that he knew for a fact what the question regarding the donation was about. 


The case continues on Wednesday.
