Court postpones case against ‘drunk driver’ accused of killing Andre Piehl

Kabelo Nyatlo (30) appeared briefly in the Randburg Magistrate’s Court on Monday on a charge of culpable homicide.

Nyatlo appeared in court on Monday after an agreement was reached with the defence attorney and prosecutors.  

 

He is faces charges or culpable homicide, failure to offer assistance, negligent driving and driving under the influence of alcohol after knocking down Piehl and his friend Je’an Francisco du Preez in Lanseria last weekend.

 

Nyatlo, who was driving a white SUV Porsche that, was released from police custody last week due to a lack of evidence.

 

Gauteng NPA said the police and Harrington Johnson Wands Attorneys, the families' appointed watching brief, as well as the members of the public, all worked together to ensure the matter passed the evidential test to meet the requirement of prospects of a successful prosecution

 

The matter was postponed to May 18  for further investigation. 

 

He was ordered to report to the prosecutors office when and if he wants to leave the province.

 

Members of the cycling community were at court to offer their support for Piehl and Du Preez.

 

"We are fed up and we want the voices of cyclists to be heard. How come was this person was released? That was shocking, hence we decided to come here and put a word out there that we are visible. We go out and make sure we are visible, we were bright colours & ensure our bikes have light, this could have happened to anyone," said Siya Didiza.

 

Didiza's sister, Ndilisa is also a cyclist, and said she had been hit by a car before while riding her bike but luckily she was unhurt.

 

She said the motorist just kept driving after hitting her. 

 

"Our message is just to say can motorists see us, there are people who cycle twice a day just to support their families, it's not fair, we need to share the road. Let's all follow the rules of the road, don't  drink and drive, it's not worth it," said Ndilisa.
