A 61-year-old DA councillor in the City of Cape Town has appeared in the Bellville Magistrate's Court on charges of defrauding the social grant system, The Times reported on Friday.
Michael Toko was accused of drawing an old age pension even though he earns about R30,000 a month as a full-time councillor.
Government regulations stipulate that those applying for the old age pension of R1270 should not earn more than R49,200 a year.
Toko also enjoys travel and a cellphone allowance.
He was arrested on Wednesday night.
The Democratic Alliance said it would only comment after it had done its "own investigation".
The African National Congress had called for Toko's head, saying fraud was robbing the poor of "bread from their mouths".
Cape Town council speaker Dirk Smit of the DA said Toko could face disciplinary action, pending the outcome of the investigation.
