The party says it will continue to challenge the law in court and push for it to be revisited by Parliament.

In his pre-State of the Nation Address, DA leader John Steenhuisen said the party believes protecting property rights is crucial for economic growth and job creation.

The Act has been in the spotlight this week after US President Donald Trump threatened to cut off funding to South Africa after accusing the government of confiscating land and treating “certain classes of people very badly”.

“The protection of private property rights is the cornerstone of any economy,” Steenhuisen said.

“The DA has always supported this and fought hard against any amendment to Section 25 of the Constitution since 2018. The DA is strongly of the opinion that the Act is unconstitutional and our view has not changed.”

At the same time, Steenhuisen reiterated the party’s commitment to driving reforms within the government of national unity.

“We will continue to use GNU structures to mount our opposition to the law from within government. We will approach the courts, arguing that this Act is indeed procedurally and substantively unconstitutional.”

On the National Health Insurance, Steenhuisen said the DA had received an undertaking from President Cyril Ramaphosa that provisions that would terminate private medical aids had now been removed from the government’s medium-term plan.

“We look forward to working with the president and the ministerial advisory committee to put in place alternatives to the NHI in its current form that will provide all South Africans with access to quality healthcare, regardless of their socioeconomic background,” he added.
